Divorce is never easy for anyone. Nobody gets into a marriage expecting that they will go through the divorce process. However, sometimes separation is the best option in marriage. At The Law Office Of Gustavo E. Frances, P.A., we are here to help you through this difficult process. Today, our Fort Lauderdale divorce lawyer wants to discuss attempts by one Florida representative to tackle the rising divorce rate in the state.

What Is Going On With This Legislation?

One Florida representative is attempting to solve the rising divorce rate in Florida with what he calls the “Guide to a Healthy Marriage” measure. This is not the first time that Jacksonville Rep. Clay Yarborough has filed this bill.

Yarborough says that the goals of the measure include curbing the divorce rate in the state as well as saving taxpayers money. This would involve requiring FL residents applying for a marriage license to read a “Guide to a Healthy Marriage,” created by a marriage education committee (chosen by the governor).

Florida has the seventh-highest divorce rate per capita in the US. Data from the American Community Survey shows that, for every 1,000 married individuals over the age of 15 in this country, around 11.67 were divorced over the years 2013 to 2017.

Marriage Is About More Than Reading A Guide

Whether the government should be placing pre-marriage requirements on those who want to tie the knot is debatable (Yarborough’s bill failed once before). However, most people can agree that reading a guide on “healthy marriage” cannot possibly prepare couples for the issues that can come up in a marriage. Everyone’s situation is different, and there are times when divorce is the best route for a couple to take. Despite reading a guide before marriage, there are several factors that can irreparably harm a couple’s ability to stay married:

  • Cheating
  • Physical abuse
  • Drug and alcohol abuse
  • Child abuse
  • Irreconcilable differences
  • Problems with money
  • And more

Marriage is complicated, and so is divorce. If you are going through a divorce, or are about to, there are several issues that you will have to deal with. This includes:

  • The distribution of marital assets
  • Possible spousal maintenance payments (alimony)
  • Child support payments
  • Child custody and visitation rights
  • And more
